ND Regulators will hold off enforcement of Internet Auctions

North Dakota regulators say they won’t chase unlicensed “auctioneers” who sell goods over the eBay Internet service until Attorney General Wayne Stenehjem concludes whether they’re covered by state law.
The state Public Service Commission licenses auctioneers, who are required to pay a $35 annual fee, obtain a $5,000 bond and attend auctioneer school if they have no experience. It is a misdemeanor crime, punishable by 30 days in jail and a $1,000 fine, for a person to regularly run auctions without being licensed.
State law that regulates traditional auctioneers may also affect North Dakotans who are paid for using eBay to sell merchandise for others. Users may post photos and information about a product on the eBay site, and solicit bids over a set period of time.
